Content The website www.business.naturecastle.ch (“Website”) uses materials such as images, photos, graphics, logos, videos, films, audio files and text (the “Material”). The Material is the property of NatureCastle, Merianweg 10, 3400 Burgdorf, Switzerland and is protected under the provisions of copyright law, trademark law, design law and personal rights under Swiss and international law. Any use of the material – beyond purely private purposes – requires the prior written consent of NatureCastle. The same applies to any modification of the material, in particular translation or other form of processing, and to any forwarding. 3. Exclusion of liability If the user downloads material or uses it in any other form, they do so at their own risk. NatureCastle is not liable for any resulting damage to the user, in particular to data, hardware or software. Liability for intent and gross negligence remains unaffected. NatureCastle accepts no liability for the infringement of third-party rights. The information on this website has been compiled with great care and thoroughly checked, but NatureCastle accepts no liability for its accuracy, timeliness and completeness. The website is intended to provide general information and is in no way a substitute for medical or professional advice. 4. Liability a) PROVIDER shall be liable without limitation for intent and gross negligence. b) PROVIDER shall only be liable for simple negligence – except in the case of injury to life, body or health – if essential contractual obligations (cardinal obligations) are violated. Liability is limited to the foreseeable damage typical of the contract, but not exceeding an amount of CHF 200 c) Liability for indirect and unforeseeable damage, loss of production and use, loss of profit, loss of savings and financial loss due to third-party claims is excluded in the event of simple negligence – except in the event of injury to life, limb or health. d) Any further liability other than that provided for in this contract is excluded, regardless of the legal nature of the claim asserted. However, the above limitations or exclusions of liability shall not apply to strict liability prescribed by law (e.g. under the Product Liability Act) or liability under a no-fault guarantee. e) Insofar as liability is excluded or limited in accordance with Sections 2 and 3, this shall also apply to the personal liability of employees, workers, representatives, organs and vicarious agents of PROVIDER. 5. Terms of payment a) The amount to be paid is due for payment within 7 days net after completion of the order or invoice, unless the order confirmation specifies a different payment term. The payment obligation shall be fulfilled by bank transfer to the Contractor’s specified account or by cash payment. b) The Client shall only be entitled to set-off, even if notices of defects or counterclaims are asserted, if the counterclaims have been legally established, recognised by the Contractor or are undisputed. The Client shall only be authorised to exercise a right of retention if its counterclaim is based on the same contractual relationship. 6. Dispatch and processing Shipping and handling charges per order (most standard orders are dispatched within 5-7 working days) NatureCastle offers standard shipping. Online orders are dispatched from Monday to Friday, excluding public holidays. Orders placed on Saturday and Sunday will be processed the following business day. – Most orders shipped via standard shipping are processed and shipped within 1-2 business days, depending on product availability. – Most standard shipping orders are delivered within 2-15 business days from the date the order is shipped. – All orders are dispatched by Swiss Post. For Austria, Italy, France and Germany, parcels are sent by DHL. – We only deliver to the country of your delivery address. All orders can also be collected locally free of charge. Import duties and handling fees may apply when exporting to EU countries. NatureCastle has already reduced shipping costs to accommodate customers. However, NatureCastle shall not be liable for any customs costs. 7. Right of exchange and cancellation If for any reason you are not satisfied with your order at www.naturecastle.ch, you can return the products as long as they are in their original condition. However, the cost of the return shipment must be borne by you as long as the product is delivered undamaged and correct. The exchange of products is not possible as long as the product arrives undamaged. The processing time takes between 7 to 10 working days after receipt of your return. Working days: Monday to Friday, excluding public holidays. You will receive an e-mail confirmation as soon as we have received and processed your return. Links from third parties We are not responsible for the content of third party websites, even if they are linked to or from the Website. Legal consequences NatureCastle reserves the right to block the user’s access to the login area if the user violates these Terms of Use and/or legal provisions. In this case, the use of this area is no longer permitted and any further use is therefore unauthorised. NatureCastle reserves the right to pursue unauthorised use and any infringement of rights, in particular the infringement of personal rights, trademarks, designs, copyrights and other industrial property rights, under civil and/or criminal law. The invalidity or nullity of individual provisions of these Terms of Use shall not affect the validity of the remaining Terms of Use.
